IF YOU WERE A NEWSPAPER CARRIER FOR THE SACRAMENTO BEE WITHIN CALIFORNIA DURING THE PERIOD FEBRUARY 2005 TO JULY 2009, THIS CLASS ACTION MAY AFFECT YOUR RIGHTS

On February 5, 2009, the Class Representatives filed the Class Action against the Bee in the Superior Court for the County of Sacramento (the “Superior Court”), asserting nine causes of action for: (1) failure to pay minimum wage and overtime wages, (2) failure to provide meal periods or compensation in lieu thereof, (3) failure to provide rest periods or compensation in lieu thereof, (4) failure to reimburse for reasonable business expenses, (5) unlawful deductions from wages, (6) failure to provide itemized wage statements, (7) failure to keep accurate payroll records, and (8) unfair business practices.

The relief sought in the Class Action was largely premised upon the Bee’s failure to classify the Class as employees and to reimburse the Class for reasonable mileage expenses. The Class consists of two groups of newspaper carriers: (a) the Metro carriers; and (b) the ONDM/Y carriers.
